An Act to amend the Divorce Act (child of the marriage)

Summary

This enactment amends the Divorce Act to specify that the term “child of the marriage”, in respect of those children who have reached the age of majority, means those who are under the charge of two spouses or former spouses but unable to withdraw from their charge or to obtain the necessaries of life by reason of illness or disability.

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. Paragraph (b) of the definition “child of the marriage” in subsection 2(1) of the Divorce Act is replaced by the following:

(b) is the age of majority or over and under their charge but unable, by reason of illness or disability, to withdraw from their charge or to obtain the necessaries of life;

Le texte modifie la Loi sur le divorce afin de préciser que le terme enfant charge , dans le cas d' un enfant majeur, s' entend de celui qui est la charge des deux poux ou ex-poux mais qui ne peut, pour cause de maladie ou d' invalidité, cesser d' très leur charge ou subvenir ses propres besoins.

Sa Majesté, sur l' avis et avec le consentement du Sénat et de la Chambre des communes du Canada, dicte :

1. L' aliéna b) de la définition de enfant charge , au paragraphe 2(1) de la Loi sur le divorce, est remplacé par ce qui suit :

b) il est majeur et leur charge, sans pouvoir, pour cause de maladie ou d' invalidité, cesser d' très leur charge ou subvenir ses propres besoins.

Affair led to mother murdering her own kids

Days after buying another woman Valentine's Day flowers, a Sydney father came home to find a trail of blood leading him to the bodies of his two young children lying next to their mother, a court has been told.

The woman had given the couple's three-year-old daughter and four-year-old son rat poison and an unidentified pink liquid before smothering them and killing them, court papers said.

She then tried to take her own life, the NSW Supreme Court was told.

Doctors agree the mother, from Canley Heights in Sydney's west, was suffering from "major depression" when she poisoned her children on February 19 last year.

She has pleaded not guilty to the two murders by reason of mental illness.

As her judge-alone trial began, the mother's lawyer told Justice Clifton Hoeben his client didn't think life was worth living after learning about her husband's affair.

Woman convicted of killing 3 kids after custody battle

HELSINKI, Finland - A court in Finland has convicted a woman of murdering her three young children and has given her a life sentence.

The Espoo District Court says Thai-born Yu-Hsiu Fu was found guilty of strangling her 8-year-old twin daughters and 1-year-old son in her home.

She tried to kill herself afterward.

The verdict on Tuesday says the 41-year-old woman was found to be of sound mind at the time of the murders.

Court papers show the murders were preceded by a bitter custody battle with her Finnish husband who was living separately from her at the time of the murders.

A life sentence in Finland mean convicts usually serve at least 11 years in prison.
